A message to those wishing to use/manufacture the Silver Fern Flag design.
As you will know, New Zealanders recently voted in the final flag referendum and the Current NZ Flag was chosen as our flag
for the future.
In light of the result, the Crown has returned all intellectual property rights in the Silver Fern Flag to Kyle Lockwood. Therefore should you wish to sell the Silver Fern Flag, you should do so with Mr Lockwood's agreement; Mr Lockwood can be contacted at [email protected].

The Silver Fern (Red White and Blue) and the Silver Fern (Black White and Blue) are Crown Copyright as at 10:30 am on Tuesday 1 September 2015. in the event that these designs are not chosen as the NZ Flag in the second March 2016 referendum, copyright will pass back to the author.
This note is from the NZ Government:
The four alternative flag designs selected by the Flag Consideration Panel for the first referendum are protected by copyright. In accordance with the Flag Design Terms and Conditions, the copyright in the flag designs is owned by the Crown during the referendum process, and following that process if a new flag is chosen. After the first and second referendums, copyright in any unsuccessful flag designs will be assigned back to the designers as appropriate. Once copyright has been assigned back to the designers, any use of those flag designs will require permission from the designers or any other owner of copyright in those flag designs (unless the use is otherwise permitted under the Copyright Act 1994).
Any promotion or advertising of the Flag Designs during the referendum process must comply with the Referendum Advertising Rules.
